Energy label C obligation: what to watch out for

Since 1 January 2023, an energy label C or higher is mandatory for all office buildings larger than 100 m² in the Netherlands. Buildings without a valid label may not legally be rented or used as office space. Yet in Rotterdam there are still buildings on the market with a D, E or F label, particularly in older parts of the city centre and in Kralingen. For the tenant, this creates two risks:

• The municipality can shut down use of the building until sustainability upgrades have been completed.
• The landlord can pass sustainability costs on through service charges or a rent increase.

Always ask for the valid energy label before signing. From 2030, a label A is expected to become mandatory, which means buildings with only a C label will need further upgrading within a few years. New construction on Kop van Zuid and in M4H comes standard with a label A or A+.

Service charges: where does the difference sit?

The base rent is not what you actually end up paying. In Rotterdam, service charges average between € 40 and € 90 per m² per year, depending on the type of building and its facilities.

At a business centre, service charges are higher (€ 100 – € 200 per m²) but usually include everything: furniture, reception, coffee, printing and meeting rooms.

Contract types and lease terms
